Cigna Property Update - Timeline for Approval Process

The following is an outline of the process going forward as provided in the Settlement Agreement between the Borough of Franklin Lakes and SHG Franklin Lakes, LLC:
  • Mayor and Council authorizes Borough Planner to draft a Zoning Ordinance to implement the Zoning Standards – completed on April 4
  • Planning Board authorizes Borough Planner to draft an Amendment to the Housing Element and Fair Share Plan (HEFSP) – completed on April 5
  • Borough’s Affordable Housing Attorney writes a letter to the Court requesting a Fairness Hearing (within 7 days of fully executed Settlement Agreement) – Agreement signed on April 18
  • Mayor and Council discusses the draft Zoning Ordinance at Mayor and Council Meeting – completed on April 18
  • Mayor and Council introduces ordinance at a subsequent Mayor and Council Meeting and refer to Planning Board for consistency review – scheduled for May 2 Mayor and Council meeting – following introduction, proposed ordinance would be posted on the website
  • Planning Board discusses Amendment to HEFSP
  • Planning Board holds public hearing on the Amendment to the HEFSP
  • Planning Board discusses Zoning Ordinance as introduced by the Mayor and Council 
  • Public hearing on the Zoning Ordinance and consideration for adoption
  • Court holds Fairness Hearing – could be anytime         
  • Developer files Site Plan application with the Planning Board – following approval of the Court of the Settlement Agreement
  • Public hearings are held on the Site Plan application before the Planning Board
  • Developer conveys 3.5 acres to the Borough following approval and prior to issuance of building permit
The ordinance/settlement would not be legal/effective until after the Court approves the Settlement Agreement, following the Fairness Hearing, even if it were adopted prior to the hearing. That is how the ordinance will read. 
This outline will be updated as the process moves forward, which will then be distributed to the public via eblast and posted on the Borough’s website. All meetings of the Mayor and Council and Planning Board have a time for public comment.
